He met the disapproval of Paul Sunday’s twin brother, Eli Sunday, whose role was also played by Paul Dano and he had to seek the consent of their father in obtaining the land. After procuring the land, oil exploration started and it was no sooner that evil started manifesting in the land and it makes one think that the land must have been a cursed land. One of the workers on the land was accidently killed in the course of the oil exploration and this was one of the many evil that was in the film. An explosion later happened, that made Plainview’s adopted son, H.W somewhat deaf (Daniel Day-Lewis, Paul Dano, Kevin J. O’Connor, Ciaran Hinds & Dillon Freasier). Daniel Plainview’s evil started manifesting when he and his son travelled to New Boston, California to meet a preacher named, Eli Sunday and tells him of his ambition of drilling the oil in their family land, something that Eli Sunday accepted reluctantly not knowing that Daniel had some evil in him. Hawkeye is an example of hybridity because white by blood but Indian by habit. In the novel, Cora is a hybrid because her mother was black and her father was white. When nature and culture collide it makes a hybridity, just like what the Mohicans did in the movie. By the end of the nineteenth century, hybridity became very popular by rapid developments in genetic. When the Native Americans lived in the Americas, they were not alone. There was a culture clash between the Native Americans and the Europeans. In the movie, the Hurons and the Europeans did not get along. Queen Gertrude, denounced by the ghost as faithless to King Hamlet, is pictured as evil by many, while Ophelia is seen as pure and obedient and full of good virtues. Not all students need additional assistance when working on their university projects if they show a high level of confidence and self-discipline. Yes, unless kids have an effective system in place. Sasanian Silver essays In the broad world of islamic art its not always easy to tell were the piece your looking at comes from, what period it was created in and what materials were used to make it. It can be complicated as islamic art differs from country to country and in some cases from city to city. Every area has its artistic specialty as does every period of time. The three bowls Im going to discuss are all pieces of Islamic art, two of which are made in Iran and on that is made in either Syria or Egypt. I chose these bowls because they all have different styles of decoration, each decoration is unique in its own way, but all decorations are considered features of islamic art. The first piece that caught my eye was this bowl on display in the Fountain of the Light exhibit. This bowl is from either Egypt or Syria and was made for Mamluk sultan Al-Malik Al Muzaffar, Saif al-Din Hajji who ruled for only one year. Just by looking at the piece you can tell it was made for royalty, and its probably not a bowl you would put fruit in. The bowls body is cast brass, with silver, gold and a black compound used to emphasize its lines. The bowls most noticable feature is one that is common in Islam, calligraphy. Some challenges for this writer are working full-time, being financially responsible for others while maintaining a mortgage and family responsibilities. Time management and a novice regarding some computer programs also provide other challenges. Many obstacles have to be conquered in an effort to ensure success. Hardin (2008) contends these barriers often put her at a greater risk for being unsuccessful. The purpose for this writer entering graduate study is the hope of expanding her career opportunities to include teaching at the undergraduate level. Her motivation to return to school was two-fold. A divorce and a lengthy recovery following a work-related injury within a year inspired thoughts of facing the future being financially independent and wondering if the recovery would be without limitations to allow a return to bedside nursing. These life changes prompted soul searching and re-motivated this writer to pursue a graduate degree, a goal that had been set several years prior. As a graduate student this writer faces the challenges encompassed with being an adult. Over the past 30 years, there has been an escalation of students, primarily women, entering graduate study. According to Hardin (2008) the motivation for many women to return to school is usually centered on a major life change. These women usually return to college in an effort to support their families. Balancing commitments, such as work, life, school and other responsibilities create a stressor to the student and pose even more challenges. As the sole provider for two children and responsible for other financial costs that entail, this writer works full-time on the nightshift. Traditionally compensation on nightshift is more than traditional work schedules. Although financially this helps alleviate one stress for this writer, another stress is created, lack of sleep. Sleep deprivation, fatigue and sleepiness negatively affect function that often results in decreased productivity (Mulgrew, 2007). This writer believes working nightshift and facing the sleeping challenge poses a potential barrier to success. Based on 2004 statistics, approximately 15% of Americans work nontraditional work schedules (Chung, Wolf, Shapiro, 2009). Adan and Natale (2002) also found that the relationship between gender and shift work support the thought women are more morning types, preferring to retire to sleep earlier and rise sooner, which results in optimal mental performance. This writer believes this to be true of her. In an effort to meet the challenge of time management, she will keep an accurate calendar and prioritize all appointments, work schedule, and other commitments. Blocking out hours of the day to focus on schoolwork as well as ensuring enough sleep while pursuing personal goals such as exercise should encourage quality work. Procrastination is time’s enemy. A few minutes of effective planning will save time in the end. This involves a continual assessment and reassessment of priorities and activities (Spidal, 2009). Financial stressors also affect the graduate student. Hardin (2008) found lack of financial support may actually prevent an adult from enrolling in graduate school. The adult student often differs from the traditional student as her financial needs often include a mortgage and childcare. Working nightshift helps alleviate the financial deficit for this writer as nightshift pays a differential. Many nurses, including myself, will work extra shifts to offset the financial burden. Attending classes may inhibit the overtime opportunity, therefore smaller paychecks add to the existing financial load. A graduate student has to weigh the benefits of an education when after graduation her financial debt will increase (Morgenthaler, 2009). In an effort to minimize the loan amount, this writer researched loans and scholarships. She consulted her employer and found there were a few scholarships available in addition to education reimbursement. The scholarship amounts are monetarily limited. Some also require a commitment to continuing employment for a set number of years per scholarship. Despite these caveats, any amount of money is helpful to decrease the debt as well as ensuring longer employment. Another challenge facing this writer is she has never used PowerPoint in any arena. This may lead to a feeling of inadequacy. To neutralize this deficit she will ensure access to the latest computer programs for her papers, research, or presentation. Psychological morbidity after the surgery is resulted from the unawareness of the condition which includes the past psychiatric history, dis-satisfaction with pre-operative preparation for surgery, post-operative physical symptoms and the negative thoughts and beliefs related to stoma and the condition of being a patient (White C.A Hunt JC, 1997). So normally surgeons are the important healthcare professionals dealing with the patient who needs to take the responsibility to collect patient information and let them know the process before and after surgery (White C.A Hunt JC, 1997). Various forms, questionnaires and surveys should be introduced for the screening purpose, where the other healthcare professionals and Para-medicals could take the in-charge of detecting the possibilities of psychological morbidities. This can even develop with applying effort in liaising with the mental health services. PSYCHOLOGICAL AND SOCIALOGICAL ASPECTS OF COLORECTAL CANCER In a recent survey on the colorectal cancer patients, they have found that the patients have a good quality of life after the treatment (Medical News Today, 2011). This is because the patients has followed the medical management with some physical restrictions but the survey also shows there are sufferers from this condition post operatively. They are mostly dealing with the emotional and social living where the life of the patient is seriously affected even after many years (Medical News Today, 2011). Even though the disease is a common one, only a few details are known about post-operative and the quality of life they lead (Medical News Today, 2011). The survey dealt with approximately 300 patients who received treatment for colorectal cancer. But after many years of investigation they diagnosed that the patients are having lots of suffering due to the disease. The reason behind suffering is not with the physical problems but the fact is very serious about the problems facing psychologically. Patients are struggling due to the psychological causes. Dr. Volker Arndt and his colleagues of the Division of Clinical Epidemiology and Aging Research of the German Cancer Research Centre (Deutsches Krebsforschungszentrum, DKFZ), the Saarland Cancer Register and the Department of Epidemiology of Ulm University did this research and found that the patients are suffering from mental strains (Medical News Today, 2011). The patients are also having secondary diseases and these were studied from the sufferers who are relatively young age (Medical News Today, 2011). Throughout the world for one year there are about one million new cases being recorded. So this takes the colorectal cancer as the most common form of cancer among other types of tumours. For the past decade there is consistent and significant prognosis as most of the cases are been detected at the early stages. Long-term researches concerning colorectal cancer patients frequently deal with repetition of tumours and/or survival rates, whereas the long term wellbeing and eminence of life of patients once completion of therapy has been of slight systematic attention to date (Medical News Today, 2011). The researchers concluded that these sufferings and problems have its impact mainly due to the age and there is lots of influence in age factor on the psychological resistance. Thats the reason behind young patients are predominantly affected by the mental illness. Therefore, the younger patients are more affected by the disease compared to the older patients. This is even more threatening and having health deficits to the younger ones than the older sufferers. But still the older patients have to come up with the physical problems (Medical News Today, 2011). A literature review clearly states that the depression state is not only to the patients but the depression is seen in the life of spouses (Goldzweig. G et al. 2009). However the communication and distress issues and sufferings between the patients and spouses are still being understudied (Goldzweig. G et al. 2009). Accommodating the primacy of gender, attention should be given to whether the demand-withdrawal pattern in female cancer patients and their spouses is similar to the demands and emotional needs of both male cancer patients and male caregivers (Goldzweig. G et al. 2009). Price (1990) developed a method for taking care of patients with altered body image (Price B, 1990). He recommended that the nurses who are dealing with the patients with body image problem should use the principles of body components. He states that the body should be viewed as three components, body reality, body ideal and body presentation (Price B, 1990). CONCLUSION As summarizing the colorectal cancer patients body image and living stoma, the issues primarily dealing with loss of energy, loss of control, isolation, feeling dirty, sexual dysfunction, fertility and the female patients face pregnancy and menopause. As Price Bob recommended the social workers, health care workers and even the relations or care takers of the colorectal cancer patients should know well about the body components principles and do the rehabilitation. The basic problem of the disease deals with the medical management, if the patient in the later stage suffering from psychological issues he must be under critical care under psychologist. Most of the health professionals believe that the patient suffering from stoma is their concern but the thought should be changed and particularly stoma care nurses should be thinking wisely in helping the psychological issues faced by the colorectal cancer patients.

In order to create in each party a duty to do or not to do something and a right to performance of the other’s duty or a remedy for the breach of the other’s duty, we need to set up a contract. Obligations of the parties:The obligations of the parties, as assigned in the terms of the contract, are governed by the general law of contracts. The obligation of the seller is to furnish the goods, as agreed upon, the buyer to pay therefore. Thus, when the seller offers to turn the goods over to the buyer and when the buyer offers to pay for them, tender of performance occurs. The seller must make tender of delivery and the buyer must make tender of payment. ?Tender of delivery by Seller: To be in a position to bring suit on a sales contract, the seller of goods must make tender of delivery, that is, offer to turn the goods over to the buyer.Failure to make this offer is an excuse for buyers not to perform their part of the bargain. The seller must put and hold the goods at the buyer’s disposition and notify the buyer that the goods are being tendered during reasonable hours and for a reasonable period of time. In a shipment contract, the seller must put the goods in the possession of a carrier and contract with that carrier for their transportation. Any necessary documents must be sent to the buyer, who must be promptly notified of the shipment.If the seller does not make a reasonable contract for delivery or notify the buyer and a material delay or loss results, the buyer has the right to reject the shipment. Suppose the goods are perishable, such as fresh produce, and the seller does not ship them in a refrigerated truck or railroad car . If the produce deteriorates in transit, the buyer can reject the produce on the ground that the seller did not make a reasonable contract for shipping it. Sometimes the goods are in the possession of a warehouse and are to be turned over to the buyer without being moved.When this situation occurs, tender requires that the seller either tender a document of title covering the goods or obtain an acknowledgement by the warehouse of the buyer’s right to their possession. The risk of loss as to the goods remains with the seller until the warehouse agrees to hold them for the buyer. ?Tender of payment by Buyer: Tender of payment by buyer means offering to turn the money over to the seller. Normally, the buyer has the right to inspect the goods before accepting or paying for them. However, when a contract requires payment before inspection, as when the goods are shipped c. . d. (cash on delivery), the buyer must pay for them first, even if they turn out to be defective when they a re inspected. Of course, if the defect is obvious, the buyer would not have to accept or to pay for the goods. Payment by the buyer before inspecting the goods does not constitute an acceptance of them. Unless the seller demands cash, the buyer may pay for the goods by personal check or by any other method used in the ordinary course of business. If the seller demands cash, the seller must give the buyer a reasonable amount of time to obtain it.Payment by check is conditional on the check’s being honored by the bank when it is presented for payment. If the check clears, the debt is discharged. If the check is dishonored, the debt is revived. In that case, the buyer does not have the right to retain the goods and must give them back to the seller. Buyer’s rights and duties upon delivery of improper goods: Except when a contract requires payment before inspection, as when the goods are shipped c. o. d. as mentioned above, the buyer has the right to inspect the goods befo re accepting them or paying for them.When defective goods or goods not of the kind specified in the contract are delivered, the buyer may elect to reject them all, accept them all, or accept any commercial unit or units and reject the rest. ?Acceptance: Acceptance of goods occurs when a buyer, after having a reasonable opportunity to inspect them, either indicates that he will take them or fails to reject them. When the buyer accept goods and later discovers something wrong with them, the buyer must notify the seller within the reasonable time after the discovery. The failure to give proper notice will prevent the buyer from having recourse against the seller.The buyer is obligated to goods that are accepted. If the buyer accept all the goods sold, she is, of course, responsible for the full purchase price. If the buyer accepts only part of the goods, she must pay for that part at the contract rate. ?Rejection: A rejection occurs when a buyer refuses to accept delivery of goods tend ered. A rejection must be done within a reasonable time after delivery or tender to the buyer. In addition, the buyer must notify the seller of the particular defect in the goods so as to give the seller an opportunity to correct the defect.If the seller gives no instructions within a reasonable time after being notified of the rejection, the buyer may store the goods for the seller, reship them to the seller, or resell them for the seller. In all case, the buyer is entitled to be reimbursed for expenses. ?Revocation of acceptance: If a buyer has accepted the goods on the assumption that their nonconformity would be corrected by the seller and the seller does not do so, the buyer may revoke the acceptance. This revocation must be made within a reasonable time after the buyer discovers the nonconformity.A revocation of an acceptance is not effective until the buyer notifies the seller of it. Buyers who revoke an acceptance have the same rights and duties with regards to the goods inv olved as if they had rejected them. Seller’s right to cure improper tender: If the seller has some reason to believe that the buyer would accept non conforming goods, then the seller can take a reasonable time to reship the conforming goods. The seller has this opportunity even if the original time for delivery has expired. In all cases, sellers must notify buyers that they are going to cure the improper tender or delivery.The seller does not have the right to cure improper tender when a buyer accepts nonconforming goods, even though the buyer may later sue the seller for breach of contract. The seller has the right only when the buyer either rejects the goods tendered or revokes an acceptance of the goods. Breach of Contract: Breach of contract occurs when one of the parties fails to do what was agreed upon in the contract. An anticipatory breach must be made by an act which indicates the party will not complete the work. When breaches happen, the ther party to the contract has specific remedies available under the UCC. ?Seller’s remedies: The buyer may breach the contract in a number of ways. The most common are: by wrongfully refusing to accept goods, by wrongfully returning goods, by failing to pay for goods when payment is due, and by indicating an unwillingness to go ahead with the contract. When a buyer breaches a sales contract, the seller may select from a number of remedies: ? Cancellation and withholding of delivery: If the goods have not been delivered. The seller has the right to keep them upon learning of the buyer’s breach.If the seller is in the process of manufacturing the goods, she has two choices. She may complete manufacture of the goods, or she may stop manufacturing and sell the uncompleted goods for their scrap or salvage value. In choose between these alternatives, the seller should select the alternative that will minimize the loss. ?Stop delivery of the goods: if after shipping the goods, the seller discover that the buyer is insolvent (unable to pay debts), the seller may have the delivery stop by before the goods reach their destination.However, if the insolvency information is incorrect, both the seller and the carrier could be sued for damages suffered by the carrier for not completing the shipment. ?Resell the goods: the seller may resell the goods or the undelivered balance of them. After the sale, the injured party may sue the other for the difference between what the property brought on resale and the price the buyer had agreed to pay in the contract. A purchaser who buys in good faith at a resale takes the goods free of any rights of the original buyer. Recover damages: the seller may retain the merchandise and sue the buyer for either the difference between the contract price and the market price at the time the buyer breached the agreement or the profit that the seller would have made had the contract been performed. ?Buyer’s remedies: A seller may breach a contract in a n umber of ways: failing to make an agreed delivery, delivery goods that do not conform to the contract, and indicating that he does not intend to fulfill the obligations under the contract. The buyer then may select from a number of remedies: ?Cover the sale: If the seller fails or refuse to deliver the goods called for in the contract, the buyer can similar goods from someone else. Then he can recover as damages from the seller the difference between the contract price and the cost of the substitute goods. ?Keep goods and seek adjustment: when improper goods are delivered, the buyer may keep them and ask the seller for an adjustment.
